GENERAL CONDITIONS OF SALE (GCS)
These General Terms and Conditions (GTC) govern any contract between a final consumer or a professional and Wine 75 CL Sarl, 2 rue Johny Flick L-1550 Luxembourg (hereinafter the "seller") concerning products and/or services advertised in the seller's online shop. Unless otherwise agreed, these GTCs supersede any general terms and conditions of the customer.
In these GTC, a consumer/customer is considered to be any natural or legal person who is acting for purposes that are not part of his or her commercial, industrial, craft or liberal activity, who purchases goods from the Seller and who concludes a "sales" contract with him or her.
These GTC apply to the sale of Wine 75CL Sarl products on its Internet shop ; those are automatically made available to the purchaser/customer on the online site www.wine75cl.com.
Before submitting the order, the customer is required to read and accept these online conditions. Submission of the order proposal implies full knowledge and express acceptance of both these general terms and conditions of sale and of what is stated in the order proposal.
The customer will be identified by the data entered by the customer in the order proposal. It is forbidden to provide false and/or invented data: the seller is exonerated from any liability in this respect.
THE SALE OF ALCOHOLIC PRODUCTS IS PROHIBITED TO MINORS. The product offers on the www.wine75cl.com website are intended for customers of legal age. By placing an order on the site, you guarantee that you are of legal age with regard to the legislation applicable to the customer and that you have the legal capacity to conclude binding contracts. In the absence of such legislation, the Customer must be at least 21 years old.
COMPETENT JURISDICTION
The present general conditions of sale are subject to the application of Luxembourg law. The contractual information is offered in English or French and the products offered for sale comply with Luxembourg law.
SALE PRICES
The prices of the products (hereinafter referred to as "Prices") and the delivery costs (hereinafter referred to as "Delivery Costs") are those indicated on the website and at the time of the transmission of the order.
The prices and shipping costs are to be considered as including tax. It includes in particular the applicable VAT, excise duties and any other applicable taxes as well as the transport costs in Luxembourg.
Despite all efforts, it is not possible to exclude that for some products on the site a price different from the real price is indicated by mistake. If, due to technical errors, material errors or other inconveniences, the price indicated on the site should be lower than the correct selling price of the product, the customer will be contacted to check whether he/she still wishes to purchase the product at the correct price. If you do not wish to proceed with the purchase, the order and/or orders will be cancelled. If the price indicated on the website is higher than the correct selling price of the product, the order will be followed up by charging only the lower price.
METHOD OF PAYMENT
Payment can be made using any of the methods listed in the "Payment Methods" section of the site.
All major credit cards and prepaid cards are accepted. Payment by credit card will be made without any additional charge. The customer making the payment confirms that he/she is the owner of the credit card used.
At the time of sending the order, only the commitment of the amount will be taken: the effective debit will take place only at the time of the confirmation of the order and the expedition.
If it is impossible to debit the amount, the order will be automatically cancelled.
It should be noted that the seller is not in a position to have full knowledge of the customer's credit card information, which is managed directly by the third party administering the payment.
Under no circumstances can the seller be held responsible for the fraudulent use of bank and prepaid cards by third parties.
DELIVERY
Each delivery contains :
- the products ordered and any optional gifts;
- the invoice, linked to the order.
- any information & marketing material.
The products will be delivered by the delivery person identified by the seller.
The products will be delivered to the address indicated by the customer when ordering.
The customer can change the delivery address after confirmation of the order, he/she should inform the seller directly via e-mail: info@wine75cl.com.
Upon receipt of the product(s), it is the customer's responsibility to check the integrity and the presence of any damage to the packaging that is immediately apparent (e.g. wet box, damaged box, etc.). In the event of anomalies, the customer will be required to detect them immediately, to have them noted by the courier or the sales staff (in the case of in-store collection) and to refuse the delivery. Otherwise, the Customer will lose the possibility of asserting his rights in this respect.
The site is structured with features that allow the customer to access the site and place the order regardless of his nationality and geographical location.
The customer shall have the right to receive the products at a delivery address of his choice, provided that this address is located in Luxembourg.
It is specified that order proposals with a request for shipment to the territories of Livigno, Campione d'Italia and Russia are not acceptable.
RIGHT OF WITHDRAWAL
The Customer shall not have the right to cancel the contract concluded on the website, without any penalty and without specifying the reason, by returning to the seller all or part of the products purchased.
GUARANTEES
Wine 75 CL Sarl takes all the precautions and know-how to guarantee an optimal sold good to the buyer.
Wine 75 CL Sarl guarantees no return of product neither any guarantee on the content of the purchased good.
Wine 75 CL Sarl is not responsible for any defects in the Products and their non-conformity to the order placed, existing at the time of delivery of the goods.
In extreme cases of severe damage to the good purchased, the customer is in right to file a formal complaint via e-mail to info@wine75cl.com with the seller concerning the severe defects within a maximum of 20 working days from the date on which the good has been delivered. The customer must present the order/purchase invoice & subsequent pictures attached to the complaint.
